Chapter 2:3 Workmen Compensation Act
paid RM500 per month or who are employed as manual workers, irrespective of their wages.
The Act provides that foreign workers, with the exception of domestic servants, who are injured as a result of a work- related accident and who are disabled for a period of four days or more are entitled to be paid compensation.
Should the worker die as a result of his injuries, or from a work-related disease, his family or dependents are entitled to compensation
All claims for compensation are made via the Labour Department
If not agree about amount paid, can hear both side and make decision
The Act is enforced by the Labour Department, as is the Employment Act and other labour legislation
OR the person covered from this act
no less than 5 workmen
public sector whose income is less than RM400/month
irrespective of their salary and who is not covered under Employee Social Security Act 1969
private sector whose income is less RM500/month
persons are excepted from this act
Non-manual workers whose earnings exceed five hundred ringgit a month
casual worker and who is employed for the purposes of the employer’s trade or business
domestic servant
Any person who is a member of the armed forces in Malaysia
out-worker
tributer - a miner
police officer, and any other person engaged to perform police duties
Employer’s liability for compensation
workmen injury by accident during working, employer have to pay compensation in the treatment and rehabilitation
not be liable to pay compensation if attributable to the influence of alcohol or a drug
No compensation if resulting from a deliberate self-injury
No compensation shall be payable to workman in respect of any disease unless the disease is directly attributable to during the employment
Amount The compensation
The maximum payment amount for cases of permanent disability is RM23,000
During Works: death cases is RM18,000.00 + RM7000.00 (SPPA-Skim Pampasan Pekerja Asing) = RM25,000.00
Outside: death cases is RM23,000.00
