CHAPTER 5: RIGHTS AND RESPONSIBILITIES OF EMPLOYEES & EMPLOYER (IRA 1967)
IRA 1967 (Section 5)(1)
the employer cannot:
prevent a worker from joining a union by putting a condition in his contract of employment.
refuse to employ a worker on the grounds he is a trade union member or officer.
discriminate against worker
threaten with dismissal or dismiss a worker who suppose join the TU.
induce a person to refrain to become a members with any kind of benefits.
Sec.4 of IRA 1967
rights of workmen and employers ( Sec.4 (1), (2) &(3).
they have right to form and assists the formation of trade union.
no interference with others in the establishment
no assistance or support with the objective to control the trade.
Exclusion of subsection (1)- Sec.5(2)
refusing to employ, promote, suspend, transfer, lay off or discharge a person for proper cause
requiring a person to cease to be a members upon his promotion to a managerial position
workman employed in confidential capacity in matter relating to staff relation.
Employees' prohibited action- Sec.7 IRA 1967
sec.7: prohibition on workmen and their trade unions in respect of certain act.
the employee have a right to refuse joining the trade union.
the workers cannot be force to join the trade union
the employer cannot intimidate any person to become a member of a trade union.
any disturb to employee can refer to: Sec. 8 of IRA 1967
reference to employee if have any complaint to Industrial Court
subsection (1):
the director may fake such steps or make such enquiries as he considers necessary or expedient to resolve
Right of The Union Member
leave any union members for the purpose of trade union business
Criteria to grant leave:
the workman must be an officer
he must apply in writing
he must state the duration of such leave
he must state the purpose
the leave applied for must not be longer than reasonably required.
