COMPOSITION OF TRADE UNION
Any worker over 16 years of age. However, union members under 18 years of age are restricted in their union activities. And union under age of 21 years are not eligible to be elected as officers of the union
Students cannot join union unless they are bona fide workers and over the age of 18
WHY DGTU REFUSE TO REGISTER TU?
Other reason is by the opinion of GD:
Trade union is likely to be used for unlawful purposes - inconsistent with objects and rules
Objects of the trade unions is unlawful
DG is not satisfied that trade union has complied with the Act and regulation
Any objectives, rules and constitution of the trade union conflict with any of the provision of the Act or of any regulations
Name of trade union to be registered
Duplication - .Trade union covering a particular group of workers are in existence
RULES OF MEMBERSHIP TU INPUBLIC SECTOR
Police, prison service and the Armed Forces and those in the confidential and security work- are not allowed to join
Employees in the professional and managerial group cannot join unless they are exempted by the Chief Secretary
can only join union which represent workers in the same occupation, department or ministry
WHAT MADE DGTU WITHDRAW THE CERTIFICATE OF REGISTRATION? - it was based upon on Trade Union Act Section 15
Union cease to exist
If DG is dissatisfied with:
Registration was obtained by fraud or issued by
mistake
Any of the objective or rules of the union is unlawful
The constitution of the union executive is unlawful
The union has been or is being or is likely to be used for any unlawful purposes contrary to its objects or rules
The union has contravened any provision of the Acts or its regulations
Formation and registration of TU is according to Trade Union Act Section 10(1)(2)
Registration and management of TU is:
DG can register or refuse to register a TU, shall issue a certificate of registration and can call for further particulars
RESPONSIBILITIES OF TU
To deter any of its members from carrying out any illegal acts
To administer the funds of the union in proper manner as in union rules
To comply with all laws, particularly the provision of TUA
IMMUNITY, RIGHT AND LIABILITY OF TU
TU shall not enjoyed any rights, immunities or privileges of registered trade union if it is not registered. (Sec 20 TUA)
