Validity, extension and service of claim forms
Claim form validity
For service in England and Wales is valid 4 months from issue: not counting the day of issue, so until midnight 4 months and one day after issue.

Service of claim form
D must be served with claim form, PoC (unless served later) and a response pack for litigants in person (served with PoC and supplied by the court). The response pack contains an admission form and a defence and counterclaim form
5 methods of service

First class post, DX or other service providing for delivery on next business day
DX: Only where D's address where service is to take place includes a DX number or the letterhead of D/solicitor includes a DX number and they have not stated that they are unwilling to accept service by DX

Hierarchy of service:
- Personal service if rule or PD or Court Order requires.
- Service at D's solicitor's business address f have been notified by D/sol that will accept service.
- Choice from: personal service, service at an address within the jurisdiction which D has given for purposes of service or contractually agreed method of service (if applicable)
- If D has not given an address for service, the D's usual or last known address- normal method
- Special rules for Crown, Agent within jurisdiction, children and protected parties

Service of claim form by C: C can request that form returned by Court to C/Solicitor to serve. Will need to file certificate of service within 21 days of service of PoC, unless all D's have acknowledges service within that time
Alternative service of claim form: Used where normal methods have/are likely to fail. Court has wider power. Possible methods; advertisement in appropriate newspaper (classic method, normally one national and one local), service on professional adviser or service on close relative.
Dispensing with service of claim form: possible in exceptional circumstances. Likely to be used to correct defective attempt rather than permit no attempt to serve
