INTELLECTUAL PROPERTY RIGHT
Definition
legal right, which is from intellectual activity like industrial, scientific, literary or artistic fields.
grant safeguard creators or producer of intellectual goods & services certain time-limited rights to control their use.
rights given to people over the creation of their minds but in certain period of time.
Example: author's copyright on a book or article, logo design represent a soft drink company and its products and etc.
Objectives: the product of the mind or the intellect, and that Intellectual Property rights may be protected at law same way as other form of property.
Types of IPR
Patents
provide protection for the invention to the owner of the patent for a limited period like 20 years. Product, process, machine, manufacture, composition of matter are an example type that can be patented.
Trademarks
distinctive sign that identifies certain goods or services as those produced or provided by a specific person or enterprise. Initial term registration is 10 years and it can be renewed from time to time.
Copyright & Related Right
rights given to creators for their literary and artistic works such as novels, poems, plays, films and etc.
Geographical Indications
used on things that have a specific geographical origin and posses qualities or a reputation that are due to the place of origin.
Industrial Design
creative activity which is in ornamental or formal appearance of a product and design right refers to a novel or original design that is accorded to proprietor of validly registered design.
Trade Secrets
confidential business information that provides an enterprise a competitive edge. it includes sales method, distribution methods, consumer profiles and etc.
Types of Prior Art
Novelty
help inventor determine if the invention is novel before the inventor commits the resources necessary to obtain a patent.
Validity
find prior art that the patent examiner overlooked so that a patent can be declared invalid.
Clearance
search of issued patent to see if a given product or process violates someone else's existing patent.
