Summary/Order of Analysis for SMJx
Overall Rule - Fed. Cts. have Limited Jx
General Rule - Fed. only hear cases that involve Fed. Question or are based on diversity Jx
Rule 1 - Fed. Cts. have Jx over claims arising under Const., laws, & treaties of U.S.A.
Rule 2 - Fed. Cts. have Jx over matters involving diverse citizens, where the AIC is > $75,000.
Rule 2(A) - Complete Diversity is required, meaning no P ad D can be citizens of the same state.
Rule 2(B) - The AIC must be more than $75,000. A claimant may aggregate claims against a single D, but not against multiple Ds. Multiple Claimants cannot aggregate claims to meet the $75k min.
