Intellectual Property Right
1. Definition - Right given to person over creation of their minds for certain period of time. - Category of property that includes intangible creation of human intellect.
2. Purpose: To encourage creation of wide variety of intellectual goods.
3. Divided into two main areas
:
i) Copyright and right related to copyright
: - The right of author of literary and artistic works. Such as, book, musical, competition and painting.
ii) Industrial Property
: - Characterized as protection of distinctive sign, in particular trademark.
Protected Primarily to stimulate innovation, design and creation of technology.
4. Types of Intellectual Property Right
Patent
Give owner right to exclude others from making, using, selling and import. Form of right granted by government to inventor.
Copyright
Give creator original work exclusive right to it for limited time.
Trademark
Recognizable sign, design or expression which distinguishes product from similar product from others.
Design
Protects visual appearance of product.
Database
Enable owner to prevent others from extract content of their database.
Trade Secret
Formula, practice, process or pattern which business can obtain economic advantage over competitor.
