Notice of Intended Prosecution
Before certain offences can be prosecuted the defendant must have been warned of the possibility of being prosecuted at the time of being reported for the offence or
Within 14 days of having committed the offence the defendant must have been served with a summons or charged with an offence.
Within 14 days of the offence being committed the defendant or the registered keeper of the vehicle (in the case of all vehicles except pedal cycles) must have been sent a notice warning of the possibility of being prosecuted.
DAFFLE - Offences which require NIPs
D - Dangerous, careless and inconsiderate driving/cycling
A - Aid and Abet any of these offences
F - Fail to conform to certain traffic signs (Reg10)
F - Fail to conform to PC on traffic duty
L - Leave vehicle in a dangerous position
E - Exceed speed limit
You will be reported for the consideration of the question of prosecuting you for the offence of .... state title of offence committed.
NIPs not requires
At the time or immediately afterwards and owing to the presence of the vehicle concerned on a road accident (Each feature must be present) or issued with TORS
At an RTC - suspect that the accident occurred because of a causing obstruction - don't have to issue NIPs
If you issue a TORS you don't have to NIP
NIP required
Will be required if an accident is so minor that the driver is unaware that it has take place
Will no be required where due to the severity of the accident , the driver is unable to recall the event
Best Practice
Verbal NIP must make sure they understand it.
Follow up with a written NIP send recorded delivery
