Under s.4 HRA, domestic judges are obliged to declare an act of parliament 'incompatible' if it breaches human rights. Whilst Parliament do not have to change the law, the declaration pressures them to.
Not only does this undermine parliamentary sovereignty, it also impedes on separation of powers, a concept vital to the 'rule of law in England and Whales.
