Q1) There are 4 main provisions for female workers as stipulated in EA1955. What are those provisions? Explain it by referring to relevant sections

Section 37 : Maternity Leave
every female employee shall be entitled for a period of not less than 60 consecutives days for each confinement
Section 34(i)
Prohibition of night work between the hours of 10 pm and 5 am in industrial and agricultural.
(Director General of Labor has the power to exempt any group of female employees from this restrictions upon the application of the employee)
Section 38 : Maternity allowances
This an amount of payment received by female employees for each day of their maternity leave at their ordinary rate of pay.
QUALIFYING CONDITIONS
Must notify employer that she will confined (within 60 days before confinement) and the date from which she intends to commence it. (Orally or in writing) [S40(2)]
Confinement must be certified be a registered medical practitioner or any medical practitioner appointed by the employer.
Female worker has been employed by the employer at any time in the 4 months immediately before her confinement OR has been employed by employer for a period not less than 90 days during the 9 months immediately before her confinement.
She is entitled to receive such allowance from one employer only. (Sec. 40 (7), EA)

RETIREMENT
Retirement refers to the time of life when one chooses to permanently leave the workforce behind. The traditional retirement age is 65 in the United States and most other developed countries, many of which have some kind of national pension or benefits system in place to supplement retirees' incomes.
- The minimum retirement age for employees in Malaysia is regulated by the Minimum Retirement Age Act 2012 which came into force on 1 July 2013.
- The minimum retirement age of an employee shall be upon the employee reaching the age of 60 years, pursuant to Section 4(1) of the Minimum Retirement Age Act 2012-
LAYOFF
Lay off is a situation whereby an employee is not provided with work by this employer for period of at least a total of 12 normal working days of a period of 4 consecutive weeks (not inclusive any leave authorized by written law).
Q4) If employees are being terminated by his/her employers, what are the amounts should they entitled to as stated in EA1955. Please specify the relevant sections when explaining the answers.
- Ten days wages for every year of employment if the worker has been employed less than two years
- Fifteen days wages for every year of employment if the worker has between two years and five years of service with his employer
- Twenty days wages for every year of employment if the worker has five or more years of service with his employer
