Grievance Handling
5 steps (individual/union or not)
The grievance can be escalated to the Head of Department within 3 days. A written response is required. If still not settled, go to step 3.
Aggrieved employee talks with company management/HR Rep. Final stage to resolve within company
Submit complaint to supervisor within 3 days. Can submit to next level supervisor if against immediate
Approach Tripartite Alliance for Dispute Management and file a claim. TADM will arrange for mediation sessions
If there is still no settlement or failure to conciliate after mediation, the case may heard at the Employment Claims Tribunal Court (ECT).
5 steps (collective/union)
Union Rep will refer the case to the Union HQ to help proceed the case further with the Company’s Management/HR Rep. Final stage that can be handled within the company. No resolution proceed to step 4
Failure to conciliate = Industrial Arbitration Court (IAC) who makes final decision on resolution
Submit within 3 days in writing by union branch official to head of department
Union and/or aggrieved employees and/or employer can refer case to MOM to review case and arrange for mediation/conciliation
Submit complaint to supervisor within 3 days. If no response within 3 days, move to step 2

Unfair treatment of the employee by the supervisor
Violation of existing employment laws/regulations
