COMMITMENT TO "DUE PROCESS OF LAW"
Established procedures; no trial without evidence/testimony to support accusations; reliance on local courts and magistrates; trials held in a timely manner; trials open to the public; trial by jury of one's peers
Article 18
People will be elected from the country to be heard in a court and take on cases.
Article 19
A court will be fair becuase people must stay behind afterwards, when the docket is full.
Article 36
If a victim loses a limb or life, or is injured. There are set punishments for the criminal.
Article 38
A person is not to be paced on trial if there are no witnesses or given evidence.
Article 39
A person may present his case to members of their own class without the jury hearing of the case.
FAIRNESS OF THE LAWS AND THEIR EXECUTION
"Reasonable" rules and regulations; equal justice under the law; recognition of customs, traditions, and established rights; restoration of property and fines if not justly taken; punishment in proportion to the crime.
Article 17
Lawsuits can take place anywhere, and can be moved or delayed.
Article 20
The punishment of a crime will be based upon the degree of the crime, and how it affected people.
Article 21
Justice is based upon the degree of their offence, and are fined by their peers/equals.
Article 24
Only royal justices are to hold lawsuits, so that the system is more uniform, and can not be interpreted.
Article 60
People would have more rights, and the Magna Carta would apply to all people.
RESPECT FOR ECONOMIC RIGHTS
Right to property; fairness in economic transactions--standard weights and measures; reimbursement for and/or restoration of property; freedom for merchants to move in order to conduct business
Article 40
No one can buy or be charged a fee for their rights. They also may not be denied or delayed fo their rights.
Article 55
Fines are based off of other acts that were similar. The baron is not supposed to judge the fine.
RULE OF LAW
Powers and privileges of the king are clearly defined and limited; charter provides for enforcement of restrictions placed on the king.
Article 1
The power of the Church is free, and no longer limited to the power of the King.
Article 45
Other men will be appointed for jobs in the jury. This will limit the King and keep everything in peace.
Article 63
The King did not have full reign on the land anymore. The church was free. Everything was to be peaceful.
