- note that patients have a right to refuse getting information or a diagnosis if they want

*Abortion and Physicians rights to refuse on conscience
- no matter what you MUST provide the referral
- it is the patients right to have access to the procedure
Information to family members
- note that in emergency situations you can give only basic information of a patient to the family if you have not gotten EXPLICIT consent from the patient
*Minors legal rights
Minors <18 can give their own consent in certain situations
- emancipation = means getting legal rights independent from your parents
--> say when you get legally married
--> you parents no longer have a say in your medical decisions

Capacity
- capacity can CHANGE
- capacity is by a PHYSICIAN
- capacity is CASE SPECIFIC
Competency
- Competency is CONSTANT
- Competency is by a JUDGE and is GLOBAL

- If a patient is making a STUPID decision
--> like refusing ABX for sepsis, etc.
--> always find patients capacity FIRST

Capacity High Yeilds
- note that psych disorders don't make you lose your capacity
--> Classic example above shows a pschyzo man who has capacity - Capacity changes from moment to moment
--> can technically ask someone 30 minutes later and their capacity has changed - ONLY exception that people LOSE CAPCITY is if they tell you they are leaving the hospital to go kill themselves
--> you then have an OBLIGATION to commit them to psych ward
