N.B.: where the damage to the personality results in pecuniary loss, both remedies are open to the P. Actio injuriandi to claim damages for the insult and the Aquilian action to claim damages for the pecuniary loss suffered.
In modern law, the P can claim both remedies in one action.

It is evident that the mere fact that municipality carried out work in a road which may become a danger to the public in the future, imposes no duty upon it to take precautions to prevent the danger from coming into existence. :warning:The duty arises only if a new source of danger is introduced.

:warning: Under RDL, an absence of knowledge is a good defence but if the D was aware he was breaching the P's rights but bona fide delivered him to be justified, it is still not an acceptable defence. Absence of malice is not an excuse.
