Requirement of Rent
In Street v Mountford, Lord Templeman said that a rent was required to form a lease
However, Ashburn v Arnold said that rent wasn't essential and that a rent doesn't have to be paid to form a tenancy
However, rent is essential for parol leases, which are leases shorter than a period of 3 years, as they are not required to be registered
Leasehold Covenants
A lease will contain several covenants, detailing obligations of landlords or tenants
Common Law
Common law implies no covenant that premises should be reasonably fit for habitation or occupation throughout tenancy
