From a legal point of view, Thompson opens the debate on the operation of actual occupation between the date of registration and date of disposition. Although a fully functioning electronic conveyancing system will soon become a reality, and this issue will come to a natural close, this does raise, in the meantime, an interesting legal point not addressed by LRA 2002. As a final point, it is apparent that Link Lending signals a cautionary note to lenders to review their procedures on inquiries and inspections where there has been an application for a loan for the purpose of refinancing or remortgaging.
