Consumer Rights Act, 2015
States that:
Goods supplied by a business must be 'of satisfactory quality'. This means that goods must be properly and safetly manufactured and should not be faulty or damaged at the time of sale.
The supply of services such as dry cleaning, work done by professionals , travel services, car repairs etc. The services must be given with reasonable care and skill, at a reasonable price and completed within a reasonable time frame. If the service is unsatisfactory, the service provider has to re-do the work at no extra cost
Goods must be as described. They must match any description given to the consumers of any models of samples shown at the time of sale on the packaging.
The act also covers the supply of digital goods, such as online film and games, music downloads and e-books etc. These goods have the same rights as all other goods.
Goods must be fit for the purpose for which they were supplied or for any specific purpose the consumer must know at the time of sales, eg a waterproof coat must keep out the rain.
Consumer Protection Act, 1987
In the case of foreign goods which were imported to this country, the consumers may take action against the importer or against any business which had branded the goods with its own name. Wholesalers or retailers are not liable under this act.
Any person injured by a defective product is entitled to sue the producer or manufacturer for damages. However, if unsafe goods have supplied, under the terms of this act, an offence would have also been committed even if no one is injured by those goods.
This act also allows local councils to seize unsafe goods. It also prohibits misleading price indications.
The consumer protection act 1987 is designed to protect consumers from products that do not reach a reasonable level of safety. Any product not achieving the level of safety which consumers are entitled to expect us said to be defective.
