Beneficiaries

Anti-lapse statute - saves the gift when predeceased beneficiary was in a specified degree of relationship to the testator and left descendants
Slayer Act - prevents beneficiary from receiving gift if beneficiary takes a part in killing the testator
Omitted after-born or after-adopted child may receive a share of decedent's estate unless omission was intentional
Simultaneous death - when two or more persons, one of whom is the beneficiary, die under circumstances where there is insufficient evidence to determine which party survived the other

Bequests

General legacy - payable out of the general assets of the decadent's estate and not in any separated or distinguished fund from other things of the same name

Satisfaction - when a gift has been satisfied by an inter vivos transfer from testator to beneficiary subsequent to the will's execution
Advancement - is a lifetime gift made to an heir with the intent that the gift be applied against the heir's share of the estate
Elective share statutes give the spouse an election to take a statutory share in lieu of taking under the will

Charitable trust

Objective must be to benefit public, but can be a personal choice and reason

Cy pres doctrine - when designated charity is not in existence at the settlor's death, the court may redirect the truest to a purpose as near as possible to the charitable endeavor designated by settlor
Termination - if trust cannot be performed as intended and Cy pres requirements are not met, charitable trust terminates and a resulting trust in favor of settlor's estate results
Constructive trust - may arise from theft, conversion, fraud, duress, or other situations requiring an equitable remedy
Resulting trust - arises upon the failure of an express trust, from a purchase money resulting trust, or from an incomplete disposition of trust assets
