Exemptions - valid for 5yrs & cannot be transferred to a new LL
If MEES do not apply an exemption need to be registered with the PRS

  • If the works required to comply do not have < 7yr payback (pay for themselves in energy savings) or comply with the Green Deals Golden Rule - where all feasible improvements have been/ or cannot be made and it remains below an E rating, sub standard.
  • Where improvements to an EPC will devalue/ damage a property by 5% or more.
  • If 3rd party consents (LA) are not available, despite reasonable effort.
  • From 1 April 2020 or 1 April 2023 (for residential and commercial properties respectively), there is a temporary exemption of six months for new owners.
    Doesn't apply if:
  • If a property has an EPF over 10yrs old, or no EPC.
  • If the property is exempt from EPC regs it is also exempt from MEES (listed buildings, industrial sites, workshops, agricultural buildings, places of worship, temp. properties and holiday lets)
  • Leases < 6 months or ⬆ 99yrs.

Aims

  • Improve the energy efficiency of the most inefficient properties (EPC F/G)
  • Work towards achieving legislative 'close to 0' target for buildings by 2050.
  • Help tackle the barrier of LL paying for improvements to benefit the tenant

Dates

  • April 2016 - Residents can request consent to install 'Green Deal' energy efficiency improvements.
  • April 2018 - Commercial properties need to comply with MEES for granting, renewal and extensions of leases. EPCs 'F/G' cannot be rented
  • April 2020 - Applies to residential properties.
  • April 2023 - Enforcement applies to all active leases

'D & E' EPC rated properties are at risk.

Non- Compliance Penalties

  • Providing false/misleading info. to the PRS Exemptions register
      £5,000.00 & Publication of non-compliance.
    
  • Failing to comply with a compliance notice form a local authority -


      £5,000.00 & Publication of non-compliance.
    
  • Renting out a non-compliant property


      <3 months non-compliance ➡ 10% of rateable value, with a min. penalty of £5,000 and a max of £50,000  & Publication of non-compliance.
      3 months/ ⬆ of non-compliance ➡ 20% of rateable value, but with a min. penalty of £10,000 and a max of £150,000 & publucation of non-compliance
