WHAT ARE THE RIGHTS OF BOTH EMPLOYERS AND EMPLOYEES?
:star:There is no interference, restraining/ coercion of employee/ employer to exercise their rights to form & assist the formation of trade union.
:star: Rights to form, to assist in the formation of, to join a trade union and participate in its lawful activities. :
:star:The right to be free from any influence/ control by an employer/ a trade union of employers through financial support/ other means.
:star: No assistance/ support with objective to influence/ control the trade union.
:star: No interference with each others trade union in the establishment, functioning/ administration of that union
CAN EMPLOYERS TERMINATE THE EMPLOYEES DUE TO JOINING UNION? WHY?
:star:According to Section 14, gives the right to an employer to dismiss or impose any other lesser punishment on an employee who, after the holding of a "due inquiry", is found guilty of misconduct.
:star:Impose any condition in a contract of employment seeking to restrain the right of a person who is a party to the contract to join a trade union, or to continue his membership in a trade union
CAN EMPLOYEES INDUCE SOME OTHER PERSON TO JOIN A UNION? WHY?
:star: Employees cannot induce some other persons to join a trade union because all employees and employers have the right to join the trade union
WHAT ARE THEIR PROHIBITED ACTIONS UNDER INDUSTRIAL RELATIONS ACT 1967?
Questioning employees about their union sympathies or activities in circumstances that tend to interfere with, restrain or coerce employees in the exercise of their rights under the Act.
Seeking the suspension, discharge or other punishment of an employee for not being a union member even if the employee has paid or offered to pay a lawful initiation fee and periodic fees thereafter.
Persuade other people to join trade union during out of the working hours
Intimidate any person to become or refrain from becoming or to continue to be or to cease to be a member or officer of a trade union
Prohibited for employer to refuse to employ any person on the ground that he is or is not a member or an officer of a trade union
Threats to employees that they will lose their jobs unless they support the union.
Threatening employees with loss of jobs or benefits if they join or vote for a union or engage in protected concerted activity.
