Unlawful Activities Prevention Act
Intro
aims at effective prevention of unlawful activities/associations in India
defines Unlawful activity
any action taken by an individual/association intended to disrupt the territorial integrity and sovereignty of India
passes in 1967
provisions
Central govt may declare any association to be unlawful by notif in Official Gazette
Central govt may constitute UAP Tribunals as and when necessary
Notif declaring any association as unlawful to be refer to tribunal within 30 days from date of publication of notif
If declaration confirmed by tribunal it remains in force for 5 years from date on which notif becomes effective
Both Indian and foreign nationals can be charged under the act
Applicable to offenders in same manner if crime committed on a foreign land
A cognizable offence
Sec 16 - Punishment for terrorist act - death or life jail plus fine if it results in death of person, other cases - 5 yrs jail can be extended to life jail plus fine
Criminalizes raising of funds for terrorist acts
There is also a punishment for conspiring to commit a terrorist act
punishment - 7 yr plus fine, sath dene wala 5 yr or/plus fine
