Legal Controls on Recruitment and Related Ethical Issues - prevent discrimination.
Race
People of all races, colours, nationalities or ethnic origin must be treated equally during the recruitment and selection process.
This also applies to all aspects of employment and in training.
In NI, such conditions also apply to Irish Travellers.
The employer would be liable if he/she allowed any of his/her employees to discriminate against other employees on racial grounds.
Exceptions:
A person of a particular racial group is required, eg, in a dramatic performance or a photograohic model.
The employment is in a private household
Welfare services are being provided to a partocular racial group and those services can best be provided by a person of the same racial group - social workers, eg.
The employment is in a small business where there are fewer than six partners.
Religion
People of all religious beliefs and political opinion should have equal opportinities in recruitment and employment.
Employees must create a neutral ares in the workplace: prohibit display of flags, emblems, posters, graffiti, circulation of materials, singing of songs which would offend or cause fear.
Employers must register with the Equality Commission if they employ more than ten people.
Employers must annually submit info about the religious composition of their workforces - including part-time employees.
Exceptions:
Any occupation where the nature of the job requires it to be done by a person holding a particular religious belief or political opinion - a minister of religion eg.
Disability
Disabled people must have the same opportunities as other people in recruitment, training and selection for employment.
Must not be treated less favourably than other people in their conditions of employment.
Reasonable adjustments should be made to buildings to enable disabled people to work there, eg, toilets, lifts and car parking space provided.
Gender
Men and women should have equal treatment and opportunity in recruitment, selection and training.
This also applies to equal opportunities in promotion.
Advertisements must not exclude any gender.
Equal pay - for this to apply, gheir work must be equally demanding, skillful and require equal levels of knowledge, devision making and responsibility.
Marital Status
It is unlawful to discriminate against someone because he/she is single, married, divorced, widowed, separated or in a same sex relationship.

Ethical Issues underlying
Anti-Discrimination Legislation :
Legislation has been introduced so thagt proper rules of conduct are applied to recruitment, selection, training and employment and that discrimination, in all forms, is prevented.
The ethical foundation of the legislation is that the most vulnerable groups in society are protected and given their rights.
Equality Commission
Established in NI under the NI Act, 1998. Aim: to build a more equal society in NI. It is an independent public body which oversees equality and discrimination law in NI.
Mission Statement: to value and promote respect for diversity, eliminage unlawful discrimination and achieve equality of opportunity for all.
How do they do it? - Duties.
Eliminate unlawful discrimination.
Promote equality of opportinity and encourage good practice.
Promote good relations between people of different racial groups.
Keep the relevant laws under review.
In cases where legal action is needed, the Commission will arrange legal representation. It can take legal action against individuals and organisations in some circumstances - eg, if they have published an AD which discriminaged against someone.
The Commission also sees that the law on equality is enforced in order to bring about greater equality in the world of work and in society in general. They have powers to ensure that employers monitor and review their employment must show that they are willing to employ all kinds of people.
In addition:
Provide info, advisory and training services.
Publish Codes of Practice whixh set standards for fairness and equality in employment, pay, housing and the provision of goods and services.
Undertake research into equality issues.
Carry out public education campaigns to raise awareness of equality issues.
