The Judiciary
is to decide cases based on existing law
Power of the judiciary
To hear and determine civil and criminal matters.
To pronounce on the legality of any legislative or executive acts.
It also has authority to interpret the Federal as well as State constitutions.
Magistrates Courts
First Class Magistrates
Civil Jurisdiction (Section 90 of the Subordinate Court Act 1948)
First Class Magistrate shall have jurisdiction to try all actions and suits of a civil nature where the amount in dispute or value of the subject matter does not exceed one hundred thousand ringgit.
Criminal jurisdiction of First Class Magistrate (section 85 of the Subordinate Court Act 1948)
First Class Magistrate shall have jurisdiction to try all offences for which the maximum term of imprisonment provided by law does not exceed ten years imprisonment or which are punishable with fine only and offences under sections 392 and 457 of the Penal Code.
