In addition to the fact that many people suffer from a progressive, harsh disease, the system in place is no effective:
Governments should regulate transplants, instead of making it illegal.
Surplus in kidneys that people (especially in third-world countries) are willing to donate.
People line up (particularly in developing countries) to sell their kidneys for $1000
People can survive with one kidney.
Rich people engaging in dangerous sports vs. people in high-risk areas selling kidneys. Can we favor one or the other? Is it ethical?
Is it ethical to say 'no' to a personal decision that could positively alter their lives? Especially when their livelihood may depend on it.
In the case of legalization, donors and doctors (and other contributing parties) gain --> particularly, monetary gain.
Able to encourage or incentive donating it with monetary compensation.
It's a human right and ilegalizing it is an infringement to their individual freedom.
A regulated system ensures the protection of all those who are involved, particularly the donor (opens up an area to sue and hold others accountable). --> gov't intervention can help these people make better decisions for themselves.
Sellers
Money that would be spend on dialysis or other treatments can now be spend on the seller.
Buyers
Contracts and guarantees are given to buyers and create a more transparent system.
Many people claim that allowing this will exploit poor people; however, these people are already being exploited by the rich and legalizing it will help remedy this power imbalance.
Controlling a legal system would not be harder (maybe not easier) than an illegal system.
Conclusion
Is it ethical to say no to saving someone who is going through a terminal disease? To say no to giving people money to pay off their debt and possibly climb up their economic status?
Organs are important.
