CHAPTER 9 OCCUPATIONAL SAFETY AND HEALTH
OBJECTIVE: to reduce any industrial accidents and occupational disease through Factories and Machinery Act 1967 and, Occupational Safety and Health Act.

ACTS
FACTORIES AND MACHINERY ACT, 1967
any premises where: a person is employed in manual labor in any process of making, altering, repairing,cleaning, washing, breaking, etc
any yard or dry dock (which ships are constructed, repaired, etc..)
but does NOT include premises where < 5 person is working
PROVISIONS
Building and premises constructed
must for the purposes of a factory must be designed and maintained in such way as to be safe to the users.
Fire precaution
must be observed
Machinery
is to be soundly constructed and guarded.
Health of the workers must be safeguared
Workers
required to be trained before using machinery
machinery can only be operated by certificated staff.
Occupational Safety and Health Act, 1994 (OSHA)
National Council for Occupational Safety and Health
appointed by Minister Human Resources
12 - 15 members (at least 3 members, one of them must be woman, from professional bodies in the field of safety and health)
The council is an advisory body which meets periodically to:
discuss proposed amendments to the health and safety legislation
to develop code of practice, give ideas and suggestion on the improvement of administration and enforcement of occupational safety and health matter.

ensuring proper arrangements for the use or operation, handling, storage and transport
the provision of information
the maintenance of the place of work and its entrances and exits
the provision of adequate welfare facilities for workers
ensure all employees have regular medical examination
DESIGNERS, MANUFACTURERS AND SUPPLIERS
design, manufacture and supply plant, machinery, equipment and substances play a major role in occupational safety.
required to take all steps to test their equipment and ensure their safety and to provide sufficient information about proper use.
EMPLOYEES
equally responsible with their employees for safety and health at work.
SAFETY AND HEALTH OFFICER
appointed by employers if;
buildings and engineering construction > RM20 millions
shipbuilding > 100 workers
gas and petroleum > 100 workers
chemical and allied industries > 100 workers
metal industry > 110 workers
woodworking > 110 wrokers
cement manufacturing > 100 workers
manufacturing firms > 500 workers
Safety and Health Committees
all employees with > 40 employees are required to establish a safety and health committee at the work place.
must consists of (chairman, secretary, representatives of employer, and representatives of employees
< 100 employees ; at least 2 management representatives and 2 employee representatives appointed to the committee.
