Types of Sentencing - Fines/Discharges
Fines
most common in Mags Court
up to £5k for an individual, £20k for a business
level 1: £200
level 2: £500
level 3: £1k
level 4: £2.5k
level 5: up to £5k
in Crown Court, only a small amount of offences are dealt with as fines, but powers are unlimited
Conditional
an offender is discharged on the condition that no further offence is committed during a set period
up to 3 years
intended for use where it is thought punishment is not necessary
if re-offending occurs within the time limit, a new sentence can be imposed for the conditional discharge, and a further sentence for the new offence
for first time offenders
Discharges
can be one of two types:
conditional
unconditional
Unconditional
no penalty is imposed
likely to be used where technically guilty, but morally blameless
