Resulting Trusts
Contributions to Property, not reflected in legal title. Presumed resulting trusts
Napier v Public Trustee: if a person buys property and voluntarily directs the transfer to the property into the name of another person, equity assumes that the owner of the land holds the property on resulting trust.
Can be rebutted: evidence must be related to the intention of the parties, at the date of purchase, or immediately after.
Presumption of Advancement: Rare, but possible.Where a husband advances the position of his wife or parent advances the position of their child.
