Frustration

1)the parties do not have to perform anything under the contract after the date of the frustration.
2)the frustration would not affect anything which takes place before the date of the frustration

Discharge by frustration
Definition:A contract becomes frustrated when it becomes impossible to perform due to circumstances beyond the control of the parties.
Examples of frustration:
1)subject matter destroyed
2)The party who performs the service dies
3)Changes in law
not frustration:
1)Contract merely more expensive or difficult to perform
2)Event delibrately brought up by one of the parties
Effects of frustration:
1)Frustration under common law
-parties do not have to perform anything after the date of frustration
-would not affect anything which takes place before the date of frustration
2)Frustration under FCA
-money paid are recoverable
-money due to be paid no longer payable
-expenses recoverable
-compensation for party who performed contract before frustrating event
FCA applies to all contracts except chaterparties,contracts of insurance and contracts for sale of goods.

Discharge by agreement
the contract may terminate automatically upon the happening of an event; upon the expiry of a fixed time; or if the parties follow a prescribed procedure. Parties may also mutually release each other from the contract.

Discharge by Performance
A contract is performed when all parties have carried out their respective promises and obligations under the contract.
3 conditions apply by discharge:
1) performance must be strictly in accordance with the terms of the contract
2) when a specific time is fixed in the contract for performance of the contract and contract must be performed within that time.
3) when the performance is complete
