Negligent misrepresentation - Misrepresentation Act 1967 - same statutory test as innocent depending on what misrepresentor can show - negligent misrepresentation did not exist before Act
Misrepresentation Act 1967, Section 2(1): "Where there has been a misrepresentation, the misrepresentor will be liable if he cannot prove... that he had reasonable grounds to believe and did believe up to the time the contract was made that the facts represented were true"

Howard Marine v Ogden (1978) - "fiction of fraud" - even if fraud not proved, if can't show reasonable belief then treated as having made a fraudulent representation in respect to remedies
Buyer asked how much weight barges could carry - seller checked Shipping Register and reported back - overstated - court said should have consulted own ship papers
Must be a contract between claimant and defendant for claimant under Act - with advisors etc., would have to sue for negligent misstatement in tort
Easier to prove - always wise to back up fraudulent claim with this - remedies can be almost identical

Closely related to negligent misstatement - tort of negligence at common law - don't need to address in exam but in reality might bring two claims simultaneously
Hedley Byrne (1964) - Caparo v Dickman (1990) - just have to identify claim is relevant and move on in exam
