Self-defence
Common law defence as elaborated on by s76 Criminal Justice and Immigration Act 2008 - "Reasonable force for purposes of self-defence etc."
Includes...
Defence of another - s76(2)(a) - "the common law defence of self-defence..." and s76(10)(b) - "references to self-defence including acting in defence of another person"
-
Prevention of crime/making arrest - s76(2)(b) - "use of force in prevention of crime or making arrest"
-
-
Infancy
The Children and Young Persons Act 1963, s16 - can be charged for criminal offences at 10 years old
The Crime and Disorder Act, 1998, s34 - removed rebuttable presumption that between 10-14 years old children are incapable of crime
-
Duress by threats
Threatened by somebody to do something - again prosecution has to disprove - six elements - only need one to not be met for defence not to work
-
-
Necessity
-
-
Duress of circumstances is not a full defence aka if don't commit crime will suffer death or serious injury
Martin - 2 questions
- Was defendant compelled to act because he reasonably believes that he was threatened with death or serious injury?
- Would a sober person of reasonable firmness, sharing the defendant's characteristics, have responded in the same way?
