The winner of the nomination is shown at the national convention (both the democratic and republican party do this).
Money in Elections
Supreame Court Cases
Buckley vs. Valeo (1976)
-
Congress had passed a law, the Federal Action Campagne Act to prevent another Watergate
They set limits on how much money a person could give to a campaign. It also set limits on how much money the candidates themselfs could spend on their campaigns. It requried to report all contributions. This created the Federal Eletion Commission (FEC) to police this.
After the law was passed someone sued saying it was unconstitutional to limit money spent and contributed. They said that it was against the first amenment and that money is a form of speech.
Decision: They said limits on contributions were good and that they helped protect against corruption. They said that limits on money spent by the cadidates campaign is not agaisht the first amendment. They said that outside groups could contribute however much money they wanted to spend. They said that when the outside groups (PACs) spent the money that they could only advertise the issues not the candidate. The court made a whole list of words that could not be included on their ads.
The list of words that could not be included or "the magic words" were: vote for, support, elect, cast ballot for, Name for congress, vote against, defeat.

General Elections

Run off election: This is when no condidate gets 50%+1 of the vote. When this happens the feild of candidates is narrowed until someone gets 50%+1 votes.
An instant runoff election is a computerized system where voters rank their choices. The one with the lowest rankings is eliminated until there is only one person left.
The Electorial College
-
There are 538 votes, a candidate needs 270+1 to win the election.
-
The winner take all rule: If you win the majority of votes in one state, eaven if it is just by one vote, you get all the electorial colledge votes for that state, with two exceptions.
Maine and Nebraska base their electorial votes on their congressional districts.
Ex. Nebraska gets 5 electoral votes and 3 districts. The person who wins the majority gets one vote and then two bonus ones.
-
Electors
They are the people who actually vote in the Ellectoral Colledge. They take a pledge to vote for the popular vote in their state. Potential electors are choosen by the parties. The party who wins gets to use theres.
