Affording legal representation in tribunal disputes
Abuse of power by landlord (eg. eviction or bad references) if remaining in property after taking landlord to tribunal
Tenants cannot take a landlord living in another state to the tribunal
Unreasonable increases in rent
Women in domestic violence situations cannot easily exit leases to escape domestic violence, obtain housing or pay off costs caused by abusive ex-partners
Unreasonable deductions from bonds – landlords not understanding ‘fair wear and tear’
Necessary maintenance and repairs by landlord – no way to enforce or insist upon anything more than a patch job
Opportunities for improvement
'Have the hard conversation (and have it early)'
- not many people like having a difficult conversation with their landlord about aspects of their tenancy they are unhappy with, but doing so can save tenants a lot of time and money down the track
‘Snap that’
- take photographs of the property (all rooms, all areas) before you move your furniture in and as you are moving out.
Tenant Advocates
– improve awareness of tenants’ avenues for legal representation such as Legal Aid and groups aimed at helping specific tenant groups, such as the Women’s Homelessness Prevention Project
