The law on consent was explained in AGs Reference No 6 1980 and later confirmed in Brown (1993). The availability of the defence is closely linked to public policy - what judges consider to be in the public interest.

Consent is a defence to non-fatal offences in limited circumstances. The availability of the defence is closely linked to public policy. It is not a defence to murder. Consent can be a defence to assault and battery but will not be a defence to the infliction of harm (ABH, Wounding / GBH) unless it falls within one of the recognised categories..
