What is tort law?
Fleming - "An injury, other than a breach of contract, which the law will redress with damages." Unlike with contract, agreement is not required.
Holmes - "(Tort) law did not begin with a theory. It has never worked one out." No clear definition.
Not created as a cohesive area of law - interests covered are wide ranging and different torts have different purposes.
Decisions hard to predict but judges usually quite clear in reports on how they reach their conclusions.
