In this case AWM failed to establish that there was a relation of quid pro quo between the Commonwealth's promises and AWM's acts.
The requirement of certainty is also inherent in offer and acceptance, as Carlill v Carbolic Smoke Ball Co shows. An offer can lead to a binding agreement only if the offer identifies the terms of the proposed agreement with sufficient certainty.
