RIGHT TO JURY TRIAL- The right to trial by jury is “inviolate.” This, however, only preserves the right to a jury trial in those cases to which it applied at the time that Ohio’s constitution was adopted. Thus, there is a guarantee for a traditional action at law (most suits for money only and certain real property actions) but not in equity actions, guardianship, probate, domestic relations, and small claims matters. Also, the right to a jury does not apply to statutory actions unknown at common law unless the statute provides the right to jury trial.
