Defences
Contributory negligence may apply; a careless plaintiff cannot improve his or her position in relation to damage by claiming in nuisance rather than negligence.
Statutory defence may be available if legislation authorises nuisance creating act.; Legislation may authorise the nuisance creating act (see for example, Cohen v City of Perth [2000] WASC 306).
