Remedies

When a contract is breached by one party, the other one, if injured, is entitled to remedy for the loss/damage suffered as a consequence of the breach
Quantum Meriut Award – an award based on the amount a court thinks ought to be awarded by way of damages as distinct from what the plaintiff is actually claiming he is due (where there was a valid contract between the parties)

Equitable Remedies
Usually awarded when the damages is insufficient to compensate the injured party for the loss suffered
Specific Performance
If there is a breach, the court may order the defaulting party to perform their obligations under the contract

Rescission
In that case, any price paid, property transferred or profit made by the contracting parties on foot of a contract will be returnable
Damages cannot be sought, as the purpose of this remedy is to place the contracting party in the position it would have been in had it not entered the contract in the first place
Applies when one party seeks to have the contract set-aside and be restored to his pre-contractual position

Rectification
Only permitted if the contracting party can convincingly prove the contract document does not reflect the true intention of the parties

Example: if a contract was made in Ireland by two Irish individuals and a sum of $100.000 was referred to, as a result of a typo. The court, having considered the facts of the case, may ‘rectify’ the contract by replacing ‘$’ with ‘€’, thereby rectifying the contract.
