CAUSATION IN LAW
Novus Actus Interveniens
-
-
The act of another person intervenes with conduct and damage. Def's conduct still satisfies 'but for' and is a cause, but courts, for policy reasons, finds that def should not be responsible for consequences beyond his control.
-
Factual causation: explanatory inquiry, 'but for' and sometimes relaxed, does not always tell us where responsibility lies. Legal causation: inquiry on legal responsibility, whether act has causative relevance or other causes superseded def's act.
