The Law and Social Work
Social Work Law
-
The Law: Sharp or Blunt?
Yet it can be harnessed, changed and use to benefit and empower individuals.
-
Complex, arduous, unclear, punitive, unhelpful, littered with gaps and get out clauses.
-
Law, Values and AOP
Value base
The law is not value free, but is shaped by many factors including historical, economic, political and social. It can be difficult to trace a common value base through statutes.
Example: Empowerment V Disempowerment - Enduring Power of Attorney (NI) Order V Health and Personal Social Services (NI) Order 1972.
The way in which we consider the law reflects our own personal value base, our own biographies etc. so self-awareness is essential.
Complicating factors
-
The dominance of agency perspective (defensive practice) which obscures user experiences and feedback.

-
-
Anti Oppressive Practice
-
-
We question the way things are (poverty, racism, sexism etc)
