3 claims:
Medical leave wages: medical leaves issued due to WORK injury/disease
Medical expenses: include hospital bills, medication & other charges due to WORK injury
max. $36,000/ 1 year from date of accident
Lump sum compensation: for permanent incapacity/death
permanent death: max $204,000
permanent incapacity: max. $262,000
can make claim if:
Injured by accident during or due to WORK
Injured during OVERSEAS assignment
Contracted an OCCUPATIONAL disease
noise induced deafness
occupational skin career
Contracted disease from EXPOSURE to biological/chemical agents at WORK
dont have to engage lawyer, MOM help settle
submit claim: up to 1 year from accident to decide if want to make claim under WICA/common law
Amt of compensation is based on FORMULA & have SET LIMIT
No need prove employer at fault, just injury was due to WORK
Part-Time Employment Act(under employment act)
Key Employment Terms(KETs): employer need to issue to ALL emp who are:
covered under Employment Act
employed ON/AFTER 1 Apr 16
employed under contract OF service for continuous period of 2 weeks/longer
DON'T need issue if already in company handbook/website...
Part time emp:
work <35 hours a week
entitled to PRO-RATED benefits based on weekly working hours
except maternity leave(same maternity benefits as full-timers)
Employment Act
OT: work that exceeds part time emp NORMAL daily working hours
pay: depend on work hours EXCEED normal working hours of full time emp
Rest Days
entitled to 1 rest day per week if need to work at least 5 days a week
if work on rest day, pay depend on if was done on employer's/employee's request
Public Holidays
entitled to PAID public holiday but can agree to ENCASH the holidays
Public holiday pay should be PRO-RATED based on no. of hours worked
Leave
If covered under employment act & worked for at least 3 months with employer. Entitled to:
sick
maternity
paternity
shared parental
child-care
Contract OF service must specify:
hourly BASIC rate of pay
hourly GROSS rate of pay(include allowances)
no. of working hours per day/week
no. of working days per week/month
Common law
need lawyer & pay legal fee
NO limit on amt of compensation but have to PROVE damages in court
Need prove either employer or 3rd party was at fault
