State Police power: general power to act on behalf of the health safety morals welfare of the citizens of that state CONGRESS CANNOT TOUCH
But if state makes a law that unduly burdens or discriminates against interstate commerce = it can violate the Commerce Clause
Congress has complete authority to permit or prohibit state regulation of what is concededly commerce within the scope of Congress’s regulatory power.
Equal Protection Clause, discriminatory economic legislation will be struck down if it is not rationally related to a legitimate state interest that promotes commerce clause
will not violate if:
- furthers an important noneconomic state interest and there are NO other alternatives.
2.) burden is undue or unresonable
Enumerated powers (listed powers):must be authorized by constitution. -trace back every act by congress to the constitution (tax spend money provide for nation's defense and general welfare)
Necessary and Proper Clause: allows congress to take action in EP but take all act NP to carry out those powers. useful and convenient in carriyng out EP

2.)plausible interpretations to statute that the court will raise difficulties or plainly ok. or alternative constructions. 3.)can law be traced to any particular power? tests relevant to that power.
