A document entailing the technical, management and operational information regarding the hazards and risks that may lead to a major incident at an MHF and the controls put in place to manage those hazards and risks
The Safety Case will provide justifications for the measures put in place to ensure the safe operation of the MHF and demonstrate the adequacy of the measures and that the Safety Management System (SMS) put in place will control risks that lead to or arise from a serious incident
The Safety Case must demonstrate that the identified controls, processes and procedures have reduced the risk of operating the MHF to as far as reasonably practicable, both for those working at the facility and for the general public
The Operator should utilize safety studies and reports that may involve similar types of facilities, related to

Once an MHF has been determined the operator must provide a completed Safety Case to the Regulator within 24 months
Must be reviewed and updated after any review of the safety assessment, emergency plan or SMS

A drawing of the general layout, including evacuation routes etc

A description of the main raw materials, the handling of these materials and storage
A summary of the major incidents and possible hazards and the justification of the approach and methods used to conduct the identification process
A detailed summary of the safety assessment that demonstrates that the Operator has in-depth understanding of all aspects of risks to health and safety of workers associated with major incidents

The MHF Operator must demonstrate that the level of risk of operating the facility has been reduced as far as reasonably practicable
Safety Case Outline
Essentially a Project Plan for the development of a Major Hazard Facility (MHF) that will help the Operator plan and produce a Safety Case that meets requirements
Describes what the Operator will do, how it will be done and when it will be done. This includes a description of the activities to be undertaken and is to be linked to a timetable, similar to a Gantt Chart.
Can be used by Regulator to plan interactions at suitable times that fit and make sense within the timetable, such as a site visit once a critical part of the facility has been constructed

The Operator of the MHF can hire an experienced third party to assist with the Safety Case outline however the Operator is expected to retain ownership of the outline by the Regulators
Those who will work at the facility must be involved in the development of the document and will be responsible for the final decisions made
Must meet the requirements of Chapter 9 - Major Hazard Facilities of the Work Health and Safety (WHS) Regulations
Must prove to the Regulator that the development of the MHF will be done so in an acceptable manner in terms of safety and be delivered on time as laid out in the initial deadline for the Safety Case

Operator must submit a Safety Case outline to the Regulator within 3 months of the determination of the MHF

Reasons for Safety Case
Several catastrophic events occurred in the past that could have possible been avoided had a Safety Case been implemented when developing these facilities
Seveso
Major incident involving the release of a toxic chemical cloud that had serious effects on the public downwind from the facility explosion
The general public had no idea that the facility was producing one of the most toxic man-made substances of the time
If a Safety Case would have been developed, not only may the original explosion have not occurred but the general public would have been aware of the dangers posed by the facility and would have insisted on better controls to prevent such accidents
