Introduction
Free Movement of persons has existed since the foundation of the EU in 1957
- 1992 Maastricht Treaty introduced the concept of citizenship of the EU
- Main Treaty provision= A20 TFEU
- On basis of this Article EU citizens enjoy a series of political, civil and socio economic rights
Secondary legislation
- Main piece of secondary legislation with which we are concerned= Directive 2004/38 on the right of citizens of the Union and their family members to move and reside freely wihin the territory of the MS
Article 2(1) Directive 2004/38 defines a Union citizen as 'any person having the nationality of a Member State'
- Almost all Eu citizenship rights are contingent on residence in another MS other than the MS of nationality
