Even if the act is something that is expressly forbidden, the employer can still be liable if it is done whilst the employee is carrying out an authorised act
Limpus v London General Omnibus - Drivers told not to race rival firms but driver ignored, obstructed and injured a horse. D still liable

Frolic of their own
If the employer is engaged in a 'frolic' of their own, the employer will not be liable
This happens if the employee causes damage while doing something, or at the time, outside the area/time of work
Smith v Stages - Employee driving back to work and caused an accident. The court decided employer was liable because he was acting in the course of employment as he was being paid at the time of travel
Hilton v Thomas Burton (Rhodes) Ltd - Employees working away from work. Took an unauthorised break by driving to a café but had an accident on the way back. One of the workmen was killed. Employers were not liable as they were on a unauthorised 'frolic' and were not acting in the course of their employment

The Control Test

In Yewens v Noakes, B Bramwell stated 'an employee is a person subject to the command of his employer as to the manner in which he shall work'
This means that of he is told how/what to do, he will be regarded as an employee

The test isn't always appropriate as the culture of employment has changed and now control is merely one of the criteria that will be taken into account
The test is not applied in situations where the worker knows more than the employer (multiple test used instead)
If the case is one of dual employement it is possible for both employers to be held liable (Viasystems (Tyneside) Ltd v Thermal Transfer (Northern Ltd)
The Integration Test

According to this test, a worker will be an employee if his work is fully integrated into the buisness
