CHOICE ON TERMINATION OF PREGNANCY ACT

ACT
recognizing the values of human dignity, the achievement of equality, security of the person , non racialism and non sexism and the advancement of human rights and freedom which underlies a democratic south africa
To determine the circumstances in which and the conditions under which a pregnancy of a woman may be terminated and to provide matters connected therewith
believing that the termination of pregnancy is not a form contraceptive or population control
A PREGNANCY MAY BE TERMINATED:
Upon the request of the woman during the first 12 weeks of the gestational period of her pregnancy
from the 13th up to and including the 20th week of the gestational period if a medical practitioner, after consultation with the pregnant women is of the opinion that : the continued pregnancy would pose as a risk of injury to the womans physical or mental abnormalities
the pregnancy results from rape or incest
there exists a substantial risk that the fetus would suffer from a severe physical or mental abnormality
the continued pregnancy would significantly affect the social or economic circumstances of the woman
PLACE WHERE SURGICAL TERMINATION MAY TAKE PLACE
may take place only at a facilllity designated by the minister by notice in the gazette for the purpose under the subsection
the minister may designate any facility for the purpose conteplanted in subsection subject to such conditions and requirement as he or she may consider necessary or expedient for achieving the objects for thus acts
COUNSELLING
the state shall promote the provision of non mandatory and non directive counselling, pre and post termination of pregnancy
CONSENT
the termination of pregnanncy may only take place with the informed consent of the pregnant woman
no consent then of the woman who is terminating the pregnanccy shall be needed
in cases of a pregnant minor a medical practitioner or registered midwife, as the case may be shall advice such a minor to consult with her parents , friends, gurdian or family before the pregnancy is terminated
