As a result, eyewitness misidentifications are the largest contributor to wrongful convictions nationwide; eyewitness errors play a role in 72% of convictions overturned through DNA (Western Michigan University). Faulty eyewitness testimonies can be attributed to two broad variables--systematic variables and estimator variables. Systematic variables are factors that can be controlled by the criminal justice system (e.g., photo lineups), whereas estimator variables are factors that are not under the control of the criminal justice system (e.g., weapon focus).
